Please help. I don't know what to do anymore. I have begged my husband to file his taxes year after year to no avail. He used to own a small business. He claims he has paid his state and federal but has not filed. He used to pay quarterly. What are the consequences to me? What if he dies? Am I responsible? Should I report it to force him into doing it? We own a home. He hasn't even taken advantage of that! Is there some kind of mediation process to get this all resolved? I am at my wit's end. His excuse is because he has two jobs now he has no time. What a sorry excuse! Please give me some advice. I just don't know where to turn before it's too late! The state is NJ. Thanks.
 


Tax returns

I believe you are, also, responsible. I
wouldn't let any more time go by. You could
be facing a huge penalty and interest. I can't
see any reason that you can't learn how to file
a return. Gather up all the 1099's for those
previous years and run to an accountant to get
it straightened out as soon as you can.

Husband not filing

You are not responsible for your husband’s tax debt if you don’t file a joint return. Since no return has been filed, you obviously did not file a joint return. He is responsible for the tax on his income. If you have income of your own, you would be responsible for tax on that income.

If your husband gets assessed a balance from the IRS, his property could be attached. If he dies, his estate would be liable for any tax he owes. So, although you would not be liable personally, you would inherit less.

As for your husband, the longer this continues, the worse for him eventually.
