Help... I'm being sued..

Hi all, I'm in California. Here's what's happening.

Some business owner somehow got my name and social security number, and applied credit for their furniture store. Now that their business is bankrupt, the creditor is coming after me and suing the amount which they owe.

I have no idea who they are, the creditor/collection agency sent me a copy of credit application with my name and ssn, but without my signature. Along with some guy's name as a business partner, with his signature. Now the creditor declares that I'm the business co-owner and wants me to pay, and I refused. And that they're taking me to court.

I guess what I need to do is prove to the judge that I'm not the business co-owner, how would I go about this? Should I consult an attorney? Because they're bringing their attorney, and there's a fee involved and that I have to pay if I lose the case. Please give me your advice. Thanks.

I would start by contacting the 3 CRA's and asking for an investigation and put a Fraud Alert on your credit report.


As for the creditor coming after you, I would bring all the proof you have that you were frauded to court and have it hashed out there.
