What is the name of your state (only U.S. law)? Alabama, My 14 year old daughter was arrested from school and charged with holding someone drugs even though the person came forward she was charged with possession of marijuana and controlled substance(2 pills). The police officer put the person name in the report admitting to giving it to her to hold but it didnt make a difference. She go to court on next week and being that she was on probation she will be taken to court on the charge she was on probation for which was disorderly conduct. What do I need to be aware of? I dont have any knowledge on the laws. Will she get time for this? will this charge affect her getting into college or even getting a job? Help please

Regardless how it happened, she WAS in possession of the drugs. Personally, I would strongly suggest that you get her a lawyer, who will be more able to mitigate the situation.

But yes, it is always possible that it will affect her ability to get a job and/or her college prospects if it's not handled properly.

Absolutely. Handling this improperly can mess her up for life. The money spent on an attorney would be well worth it.

However, I'm also going to suggest that you consider this a major wakeup call. Druggies don't just hand their stash to an honor student sitting in the library. She clearly is involved with serious drug users - and you need to do something about it.

Bingo! This little girl has already got disorderly conduct charges against her severe enough to warrant intervention.

And nobody but nobody has ever been found with drugs on them for their own personal use. They were always "holding it for a friend" who has a real drug problem. They, of course, were sitting in the library studying, just minding their own business. And it was just two pills.

She very well may have some drug issues and if you have an attorney, you may be able to get some sort of deferral to treatment for her. Don't be oblivious, this young person may very well have serious drug issues already, and is definitely in need of help beyond her family.

I have to agree with misto and comm. It is very unlikely that your daughter was sitting all alone in the library, or a classroom, or under a tree, blithely reading Homer's Iliad in the original Greek, when some random stranger shoved weed and pills into her purse/pocket/hand as the cops were chasing him/her. Nor is it likely that someone walked up to her and said "Hey, look! Ms Home Ec teacher gave me this organic Oregano and these funky new beef stock pills! Can you hold onto them for me while I'm in PE? I don't want someone to steal them from my locker!" Come on... she most likely knew exactly what she had in her possession and is trying to make it sound better than it is.
