In February of this year, I was passenger in a vehicle hit from behind by large van, while we were waiting at a stop light. I have undergone physical therapy, cat scans, myelograms, etc. and recently had cervical fusion surgery. Have been off work 8 weeks and am now back at work but undergoing rehab 3 times a week. The driver of the van had a policy with limits of 20,000 per person. (?)
My medical bills now total over 60,000. The driver of the vehicle I was riding in has very high limits of coverage. I understand from her ins rep that they will cover my additional medical..and they have mentioned pain and suffering expenses. What is this and how is it calculated ? Texas

I am not an attorney nor do I proclaim to be. My posting here is only my opinion based on my experiences. I would always suggest contacting a lawyer to confirm your rights.

It has always been my understanding that when you are a passenger (in a motor vehicle accident) and are injured, you receive compensation from the insurance company for the driver of the vehicle you are in (despite who was at fault.)They in turn will sue the insurance company of the other driver. Be sure you do not settle for less than what it is worth. Please keep in mind that you would NOT be suing your friend but rather their insurance company. No money will come out of their pockets for your claim. Good luck...
