I am in a battle with my landlord over a concession that was promised to me with regards to many incidents and complaints that I had and were all documented. After some debating they agreed to a one month concession for December 07 and this was arranged with their attorney. Now mind you it is March now and it is still showing my December rent past due. They have sent me 3- 3 day pay or quit and have never acted on them. I have alway paid rent on time and I alway put in the for at the bottom of the check what month that check is for. On March 20th I get a letter in the mail saying that my February rent is due and they crossed out my March rent info and wrote in February rent and that my March rent is now due. Now this is the first time hearing of this. I went and pulled my check for February from my bank and it has cleared and it states for Feb. rent and no changes to that info space. I pulled my January check and it say for January rent. What they have done is posted my January check to the December rent, and February rent to January and so on without my knowledge. First of all December was to be a concession and can they legally cross out my note for what month my checks are to pay for their own benefit and trying to get out of the concession which I have all documentations to. Can they make changes to my check for their benefit? Don't they have to notify one and get permission to cross out what I wrote? If anyone can help I would appreciate it!

Tenant should write a formal letter requesting LL and attorney to update their records to correspond with the rent concession made in accordance with their attorney’s letter agreement. If there is no response within ten (10) business days from the LL and attorney begin legal action. Tenant needs to immediately file a SCC and take the check and attorney letter documentation to court to demand payment or reimbursement for December 2007 rent.
