I was arrested for shoplifting. This was my very first offense. I have never been in trouble with the law before for any reason. I went to court and told 2 days jail and 2 yrs probation. I got an attorney, I was so confused. Attorney said DA was talked into making it an infraction. The day before my new court date the attorney called and said the DA'S boss said no to the infraction and 1 day in jail, 2 yrs probation. I was told that here in calif the when you have probation they have the right to come into your home day or night for those 2 years to do a search. Is this right? What rights do I have. I can't believe this is happening. As I said I have a totally clean record and never been in touble in my life. Why such a harsh punishment. Please tell me what I can do. I paid all this money to my attorney, he said he could probably get this down to an infraction. Now I'm going to have a record for life? Please tell me what I can to!

Yes - being on probation does open the door to routine searches of your person and property by probation officers - this is a condition of probation. You cannot object to this as it is a condition of your community release. The only way to get out of this is to take all jail time instead of probation, which I doubt you would want to do. Talk to your attorney about trying to arrange your sentence so you may be eligible for expungement of your record in the future if you successfully complete this sentence - may be your only way to "clean" up your record.
