I moved move out of my marital home (divorce after 28yrs). I found an apt 3 bed/2bath w/1 sm storage unit, I had a 4 bed/3bath 2 car gar. My sons are grown + out of the nest. I used 1 rm for storage + kept other rm as an office w/bed in it. It’s a “16” bldg’s complex, + I signed the lease 11/15/06 moved in 12/1/06.
I am handicapped + it was gonna take time, he did not charge me until the 1st of the month. I gave my bldg’s owners’ (BO) his Property Mgr (PM) 1st months rent $650.00 on 12/1, then I gave my sec dep (all my deposits are refundable unless the place was a disaster) the same amount $650 in 1/07. I have 2 small pets; apet deposit of $250 3/10/07.
I found out (thru my PM) that each bldg is owned by a different person + each has their own PM. Within 2 months my ‘PM’ was fired. The HOA hired another person to do the job. She was not very well liked by every there. She did a horrendous job, + I’ll leave you with that! The “Home Owners Assoc” (HOA) fired her + hired a 3rd ‘PM’ but only PT, until they got someone. It’s 2 months later. The HOA has a 4th ‘PM’ within a yr. From July - 8/07 moved in, + got into her job + things were turning around in by 9/07.
On 10/21 there was a shooting!!! This was only about 300 yards from me. I started to look at some places because I didn’t feel safe + ‘I scared to death’. I gave my term letter 12/1 + I had hoped to be gone by the 15th. So I only paid ½ my rent. In my letter I asked for a 2 things. 1st) was (2) letters, one letter saying that I paid my rent on time, my ex ruined my credit, he stopped paying on the house + it was ‘foreclosured’. So my credit is really bad, + he messed up on some other accounts too. The 2nd letter was to say that (Of course ‘AFTER’) my final ‘walk thru’ that I'd get a letter that my 2 pets did no damage to the apt. 2nd) I wanted an appt for the ‘walk thru’ DIRECTLY after I moved out. I had to go in for surgery the 7th of Jan ’08. My Dr wouldn’t allow me to drive after the surgery for awhile. I shouldn’t have tried to call 25x in Dec. without a returned call. I had surgery the 1/7/08, and after all those calls by now it has been 32X I called. She FINALY called 1/9 + we scheduled a ‘walk thru’ on the 1/14. After my Dr’s appt-well she never showed.
I said alright. I had an older man do a final ‘walk thru’ so we didn’t leave anything. I thought that I should wait to hear from her so I waited + nothing, so I sent 2 notes asking for my dep, + the last one was certified asking for it back. I knew it takes 30days to get it back. They tore the whole carpet in the apt out due to the BO's are putting in all hardwood floors (only in the living area not bed rooms + only on the bottom floors). I knew my place just had to be vacuumed, and steamed cleaned in the major traffic area in front of the front door; even when we spoke the last day-she said no worries because they are going to take out the carpet anyway.
I got my BOs’ address. I asked for it back. They said I did over $3grand in damages! My BO's sent me a note ‘what gall did I have asking for my deposits’. He wants to come after me I said go ahead. But he had better have the correct pics and receipts trying to get carpet cleaned. Plus I had witnesses that would and could state the condition of how it was left. I’ve asked to see them 3x. I have not heard or seen anything. Almost done…
Now it’s April + he hasn’t answer back to any of my emails.
I went to court yesterday + I said if the place was in such disarray then, why wouldn’t I stop trying to ask for a walk thru? I am not paying for their hardwood floors. I sued the Registered Agent for the HOA, and then the association. I meant to put my bldg owner there as well, but I didnt because that’s what I thought their Reg Agent was for. I will put the current PM down this next time. The lawyer keep saying ‘whose name is at the top of your lease?” it says one name , and not the complex name( its the PM’s company who I originally sign'd on with + I was told that everything just changes hands to the current people, because I had a lease for that apt. I should have put the current PM. I am stuck!
I need some help, if you ask me some questions I will answer them. I think I have to go against my bldg owner (who lives in Colorado-I live in Georgia), and the current PM, and the Registered Agent because the current Reg Agt is in charge of the whole entire complex as their lawyers. My main question is do I go after him here because the transaction took place here and his property is here in this state? Or do I have to go after him in Colorado and get it transferred here and if so how do I do that? I am on a major fixed income. I used my stimulus check for this case. I have only enough to do it one more time. Please some one help?
