This is a prime example of why escrow or a real estate attorney should be used to close a real estate transaction. To all Sellers and Buyers: take note.

This is the way it should have been.
You open escrow and then deposit your check to pay off the contract for deed. Escrow holds these funds until the old lady signs the deed. When the deed is recorded and you are the owner, escrow gives the old lady her money.

Now you need to hire an attorney to send a demand notice to forward the signed deed for recording. I guess this old lady can sell the property to someone else or deed it to her lover boyfriend bridge and bingo partner. If the lady had a mortgage, you had better pray that she used the funds you gave her to pay the mortgage off instead of going to Las Vegas on a gambling trip.
And what happens if she kicks the bucket prior to you getting your deed? You may have to wait another 6 months or even 2 years while Probate and the her Estate is settled. What if the heirs file claims against her property saing that the property belongs to them as direct beneficiaries. Now add another 2-3 years. By the time the dust settles, you may be the same age as this little old lady.

I paid off my house in July 2000.....and now here it is Nov, 2000 and they have not yet signed the house over to me. I bought it rent to own from an old lady that died. and her kids are taking their time getting papers signed over. Is there anything I can do or should I go ahead and just wait. I am confused on what I should do.....Please let me know.........thanks
