help my wifes husband has visitation and he is a sex offender

this man is a convicted sex offender and a known drug user and he is fighting for 100% custody. he has threatened me with my life 3 times. and he does not have a study atmosphere for the child i need som help finding a way to keep his visitation away untill the restraining order hearing. the judge will not sign it untill the hearing. and he has threatend to take the child out of state whenever he wants. and the judge still dont listen nor will sign the order.

i am a little confused? why would a judge not sign if this man is a convicted sex offender?

i am in idaho the judge has already signed off on child support in full. and gave this man 49% custody

Yikes, I can't believe that a judge would give a convicted sex offender more than anything but supervised visitation. That is really scary. Was the restraining order filed on behalf of the child, on your behalf, or on behalf of your wife? Normally, I thought a Temporary Restraining Order at least is in effect from the moment you file it until the hearing.

well, if the judge made that ruling knowing at the time the man was a known sex offender, i would be upset too!

you can always try and modify the visitation, which you can do yourself.

go to the idaho web site and look for links to their gov section and/or child support section and the form should be there, if not, get one from the court house.

here in florida if there is a known sex offender in the neighborhood it is told on the news to allow the people to know.

the restraining order was set to protect my son my wife and her brother as well as myself.

Iam confused also I am in N.J. the restrainign order took away his visitation time from every other weekend no overnights to two hours every saturday. With the TRO no visits til the hearing at the hearing I explained to the judge what has been going on toward me and toward my child he ordered a risk assesment, dv assesment,best interest evalution, til those are complete two hours every saturdday. Also when I orignally asked for supervised visits at the hearing the judge asked me what I propoes to do I told him I tried to make arrangements with the neighbors to help out for a neutral party but they said they coudl not be committed to every saturday so he lost his time for now, you need to truely stress you concerns about the siturion explain it all don't hold back this is your one chance to set it right!!!!!!
