filed arrest warrants against ex for identity theft related crimes, she was arrested and awaiting indictment by grand jury. her attorney went through a local judge to have a preliminary hearing regarding the matter. am i legally required to appear before this hearing (locally) even though the state prosecutor is going forward and prosecuting the case. this hearing isn't a subpoena, but i was wondering what the legal ramifications are. any information would be greatly appreciated!

...required to be there if no subpeona was issued. I would if I were you, if for no other reason than to convey the message that I was serious and wanted top be on top of things.

I don't know what state your in, but in Ca. sometimes the detective or investigating officer is enough at the preliminary hearing. They can testify to what the victim told them.

If I were you I would call the DA prior to the court date and confirm if he wants you there or not. If there is a handling detective they might be able to answer that question.

If they do need you in court and you don't show up, that could cause the case to be dismissed.
