Help on settling on an auto accident

I was involved in an automobile accident on St Patricks Day. Situation was this....I was at a dead stop with my left turn signal on preparing to make a left hand turn into a development. (not at a red light) Out of nowhere (I didn't see him coming) I was rear-ended at a rate of speed of about 45 to 50 MPH. All three of my kids were in the car at the time. The man that hit me, who was alone waited about 5 minutes before coming over(He was immediately on his car phone) to see if we were OK while meanwhile I was trying to calm the kids down who were crying. The man admitted total fault...said he didn't see me when he glanced up. The police came and took all the info etc. The man did get a citation.
Anyway, after calling insurance companies my son and I did go to the emergency room did x-rays on me and checked him out and said we looked ok and to come back if it got worse and to see a doctor.
Turns out that the adjuster from man's insurance co deemed my car totaled. Ok...they are paying my car off leaving me with almost $400 leftover. I talked to his insurance company and told the guy that now I had no downpayment on a new vehicle and that I had a years worth of payments on my car which was only a year old!!!
The agent said at first that since there was a bodily injury claim out that maybe he could get me some funds for downpayment on a new car....for me to go looking for what I wanted...which my fiance and I did.
Called the insurance man back today and he asked how much I put down on my original car that got totaled and asked if I had receipt. Told him I did which was $2600. So here I am thinking he is gonna pay for this but said he had to talk to his supervisor.
He calls me back starts talking about the bodily injury claims ...how I could keep mine open and maybe I could close my sons with the agreement that if something may come up they would pay for it.
My question finally is this..... What is this insurance company responsible for? They are going to pay my car off which leaves me carless with nothing to go with it.
He asked me what my medical bills added up to and doesn't my PIP (personal injury protection) pay for that? I know it does so why does this guys insurance company need that info?? Are they going to pay for it too?
I am going to the doctors tomorrow for a follow up and I am not comfortable with how this is all going down. Do I need a lawyer? What are my rights?? Isn't there a pain & suffering clause that insurance companies have in claims? Should I ask my insurance company for help in this matter? How much leeway do claims adjusters have with settling claims?

Since you have an injury, I always think that you will better off with a lawyer.

So, get a lawyer.
