HELP PLEASE, bad builder and same insurance as mine

I am in Pennsylvania

My house has suffered damage, due to bad construction. My insurance company denied my claim. However, they said that my builders insurance should cover the cost. They even gave me a letter from their engineer, that blames the builder.
I have come to find out that my builder has the same insurance company as I do.
So far, (it's been 2 long years) the builders insurance has not claimed any responsibilty towards the damage. At least this is what my lawyer has told me. I know for a fact that this insurance company HAS paid a few other cases that were exactly the same as mine. Any advice on what I should do? Please, my house is just getting worse by the day, and my lawyer told me that we were in the "discover phase" (we have been here for a year)

The fact that you have the same insurance company has nothing to do with this. Your policy doesn't cover poor construction/design. The builder's policy does - but if there are other claims to pay and they were filed prior to yours, you could eventually be SOL. Your lawyer has the answers you need - not us. We don't know, now will we be able to know, through a forum, all of the details.
