I was recently pulled over leaving my house by the sheriffs... They had a warrant for my car and house upon searching they found 3.5 ounces of MJ and 9 grams of crack.. In order to buy some time I told them I could set somebody up They told me they could make this all go away like it never happened... I have 0 priors 33 years old and a 65k a year job what kind of time well i be looking at if I don't cooperate I admitted to possion of both on tape and then they shut it off when we talked about working with them. I don't think I should set somebody up they didn't do anything wrong to deserve to be snitched on. I guess my question is if i decide to work with them how do I do it and really be free like it never happened? If i don't cooperate what kinda time well I be getting?

Well, what state are you in?

Maybe you shouldn't be playing games with the police. Decide what you want to do and then go through with it.

If charged as sales--according to guidelines--if you had 10 grams of crack, you would be looking at first degree with minimum 7 years but no more than 30 years. At nine grams, you could be looking at 2nd degree with minimum 4 years but no more than 25 years.

Federal from 0 to 40 years.

You need an attorney to advise you on your options and solidify any potential deal in exchange for CI.

There is no guarantee w/out a signed contract, which you will never get. You may get a contract to stipulate your role, but you will get no such guarantee from the detectives or d.a. unless this is a very high profile case. I do not see you getting much in the way of favors in this situation. As far as the situation goes if you do not cooperate, who knows? You never said what the charges are. Regardless, hopefully with a decent attorney yu could get a small amount like that reduced to simple poss. But, your thread was vague. Was the drugs in seperate bags etc.. Bottom line, you know what the right thing to do is, why should someone else get in trouble for you. Also you are 1st time offender, non-violent, it should not carry active jail time.Maybe even some sort of diversion program if you are willing to plea. goodluck.

My two Cents

I would be hesitant to go forward without a signed contact that lays out your duties and what you will receive if they are fulfilled. I would say dave33 was correct in his assumption that as a first time offender you would likely get face minimal punishment. But any drug conviction will haunt you forever. Consult your attorney they can contact the DA about a contract.

Your assumption that you shouldn't snitch on someone or set them up since they didn't do anything wrong is incorrect. They are drug dealers that's what they did wrong and they would roll on you in second if it would help them.

I wouldn't worry too much about the feds getting involved the amount is small and they are generally looking for large assets they can seize.

I believe if you help the police for moral reasons that's absolutely fine. I also believe that if you help the police for purely personal gain, there is a high chance of things getting screwed up and no justice being served.
