My husband and I get a tax refund this year however we owe the IRS a lot of money. Because of our bankruptcy they have said that we dont' need to pay them anything right now. Our discharge for the bankruptcy is for the middle of February. Can the IRS take our refund if we file before the middle of February or because they said we dont' have to pay them anything right now they wont' take it.

If you owe the IRS money, you won't get ANY refund, they will keep it to offset what you owe them. The automatic stay of your bankruptcy keeps them from taking anything or asking you to pay now.
