What is the name of your state? California
We signed a contract with an agent to represent us in the sale of our home. She has completely lied her way through the entire transaction. The final straw was when she changed the list price of the home without authorization. She also listed on the MLS that we would entertain offers between 570,000 -619,000 which we had no desire to do. She listed on MLS with a 3mo & planned to relist as a new listing - as far as I know MLS frowns on this. We requested she cancel our contract ( we have a clause that states we can cancel after 4 months if we chose not to sell) she is trying to hold us to our contract for 7 months. Is there anything we can do? HELP PLEASE!!!

why do you care about MLS "frowing" sounds like a good tactic to not seem like your overpriced house (did I say that or just think that?) is languishing on the market.

Have you chosen not to sell?

sounds like they are doing their job, trying to sell your house, a different agent wont make different buyers see it if its on MLS.

Although the agent should have had that they would entertain any offers she shoud not have put a lowball price on it. In the listing it should have had the highest price and not a low price. Who in thier right mind would offer 619,000 on a house if they know the owner will take offers for 570,000

Actually, this kind of listing has become more and more common. This is not unusual. And she's really doing you a favor listing your house for 3 mos on MLS and then relisting, this means your house comes back on the market as a brand new listing, which gets special placement in the MLS.

However, if you have lost faith in her then it's probably best to get someone else. I don't know how long your listing contract is, that was unclear, but if it's over, then get another agent.

One thing though. If your house hasn't sold in a reasonable length of time, it's probably priced too high. The market is really cooling down right now what with the higher interest rates. Good luck.

The only thing I see that is wrong is changing the price without authorization and using the value pricing system without your knowledge. However, I'll bet that if you look through your paper work that you signed when you listed the property, there will be a form that allows her to do this.

What YOU can do:

1: Read everything you signed carefully.

2: Call her manager/broker and asked to be assigned to another agent

3: Cancel the listing and do not relist with another company or try to sell
the home yourself until the 7 months is up (original listing period.)

4: Lower the price.

5: Raise the sales commission by 1% so it will be shown more.
