Help! - Upstate New York - Moving for April 1st

I know you have to give notice before you move out of an apartment. Does it HAVE to be 30 days?

Can you move out in the middle of a month when you usually pay on the first?

If so do you have to pay rent for the rest of the month you're not actually in the apartment? Or just the time you are?

You have to give a 30 day notice in NY, so if you gave it for less you would owe for Aprils rent,

UNLESS you advertise for the apartment, show the apartment, and find a suitable tenant and the tenant signs a lease starting on April 1st...

Becuase the landlord CANNOT charge 2 people rent on the same apartment.

Here is the rule: The landlord is legally entitled not to lose even ONE DAYS rent.

So it will be deducted from your security.

Also if you broke a lease, you might be liable for Mays rent too, if he has no one to re rent the place.

PLUS any damages you did, he will take you to small claims court and get a judgment and they wil find you.

SO Pay the landlord everything you owe, and get it in WRITING!

So if my 30 days ended in the middle of a month I would only have to pay for those days?

I do not have a lease or a security deposit.

And technically up until the second week of February I was not the one who the apartment was being rented to. That person left to go into the army. And there was never a specific agreement regarding me when he left.

All agreements on this are ALL verbal. How would that hold up in court without any witnesses to conversations?

Also, as far as cleaning an apartment, should you leave it in equal or better condition as when you moved in? Or does it have to be spotless regardless of the condition in which it was when you moved in?

You pay your rent on the first, it is for the whole month PERIOD!

you could move out on the 2nd, the landlord doesnot have to give it back... UNLESS he has a signed lease from a tenant that starts on the 2nd.

And YES clean it good, take lots of pictures, and have the ll do a walk thru and agree in writing as to how much of the security he will send you. Since you have NONE.....youd better get it in writng how much you owe the landlord and pay him by check.....

Because he can sue you in small claims court and get a judgement which will stay on your credit report...


SO then who is supposed to pay for the other half month?

The LANDLORD??? are you nuts...YOU PAY!

NOW do you see the value of a written lease?

Does it matter at all that I told my landlord in January I was looking to move out and that I specified I was aiming to be out by April 1st?
I suppose it wasn't a real notice, huh?
But my argument is that he could have been putting the idea out of a place for rent to people he knew, not necessarily the public.

well it wont hold up in court...being sort of, kinda vague....

So before you move get the landlord to sign a release that you owe him ZERO!

IF he signs it then you are free and clear, if he wants more money PAY him then get him to sign a release

AND NEVER LOSE IT..... because a couple of years down the road when you apply for credit, and a judgement shows up, from this landlord you will have the proof you owe him ZERO!
