Will I be required to file a separate bankruptcy. My husband is deceased? Some of the bills are in in name only and some are in both our names.

Since you husband has passed away, a separate bankruptcy is all you can do. List all the accounts, including the joint ones, they'll be discharged. Since they can't go after him if you have the 'joint' debts discharged under your name, there's not much they can do about it. I suppose its possible they could go after the estate, if he left one. Do the creditors know that he has passed away ?

Have you asked an attorney about this yet ?
