help with contmept non-support

My husband is dealing with the mother of his child who is refusing to pay support. He has sole custody, with the mom receivng only supervised counseled visitation which she also refuses to do. She has not seen her child in over four years. He has been dealing with support enforcement but they have been no match for what the mother pulls out of her hat. I am afraid they will never get her to pay. My 12 yo step son is mentally disabled and requires so much care that I can not work full time, but we are just over the limit for any govt. help.

Here are the current facts:

An order for support was entered in Aug. 2001, 173.00/month for one child. She did not pay at first so arrears were added +20.00/month.
She was arrested for drug sales and placed on bail, one of the conditions was pay support, so she did. Up until her incarceration for 3 years. She never told domestic relations she was incarcerated nor requested a reduction so her arrears grew.

My husband became sick and could not work for a year and a half so he received TANF. The arrears after 2 1/2 years were 3,500 to husband and 3,000 to welfare.

Mother was placed in a halfway house and began to work full time and pay support, not all that was ordered but some money came in every week.

Upon her parole she continued to work and pay support, but when her 30 days under strict parole supervision ended she quit her job and has not worked since July 2005. She has parole for 3 years.

My husband took her back for a support reveiw in OCT 2005. She was a no show and the order defaulted to $250.00/month + 40.00 arrears.

Enforcement only began when my husband demanded they do something after 90 days with no paymnet. They have brought contempt charges agianst her but only for a show of cause conference. THe first 3 conferences they just told her to get a job, reported this to her PO, and gave her 6 to 8 weeks each time. She did pay a little each time, but never even the 173.00 she was originally ordered.

The 4th and 5th times she was brought in for a compliance conference she gave them false job info so a wage attachment would be ordered and she would be left alone for another 30 days. Niether job produced a payment.

The 6th time She showed up, payed a 2 month purge amount in full for $500.00, and that dropped all contmept proceeding against Her. She told them she was working as a subcontractor so no wage attachment can be given, so she was free to go.

30 days went by again with no payment so my husband had to file a contmept charge again. The enforcment officer was FINALLY going to serve her to appear before a judge for willfull contempt. This time she checked herself into a hospital the day before the conference. They let her go and rescheduled it for SEPT. 9th 2006.

She has now just informed the enforcement officer that she will be moving across the state 4 hours away, to live with her new boyfriend. She will be working for her boyfriend's family resturaunt making only $3.00/hr + tips. So she has filed for modification. She also wants to move enforcement to the new county.

Here are my questions:
If enforcement moves to another county, will my husband be the one who must drive 4 hours away if they ever do get her in front of a judge?

THe new address she has provided to enforcement has come up as false and undeliverable. Isn't that illegal?

One of her conditions of parole was to maintain a full time job, pay all fines and court costs, but child support was never written into the agreement, she forgot to tell them she had 2 children to 2 different dads she pay support to. But even with out that , her PO said she was current on all parole conditions, and that child support was a priority over the court costs and fines. How is this so if she has not had a job in over a year, and has not paid her support? She obviously is paying on her fines and court costs or she would not be free to move.

Something smells really bad here, and We can seem to get any answers from the PO or enforcement. IS there some other recourse we have'nt tried??

Keep in mind that CSEA is limited in what they can do. Do you have an attorney because this sounds like something you really need an attorney to handle and go straight to court. How far is she behind?
 
We really can't afford an attorney. We spent 4 years getting custody away from her. It should have been cut and dry, but her goal was to wipe us out so we could no longer afford to fight. It almost worked, but she was arrested for selling drugs to undercover officers. She had no lawyer after the first year because she refused to pay him. So she just refused to cooperate and drug us through a trial that cost us a fortune. Her lawyer filed a judgemnt against her for $1,500.00 and hasn't seen a dime of it for 6 years. We have a judgement for attorney's fees for $2, 075.00 from all of the antics she used in court to try to bankrupt us. We still owe our 2nd attorney over $3,500.00 from when she got out on parole last year and started fighting for custody/visitation again, this time being an ex-con she had legal aid at her disposal. THey even eventually dumped her case once they learned the truth. She abused and neglected him, abandoned him, and caused all of the emotional and mental disabilites he has today.

She has only ever paid support for 6 months prior to jail , 6 months in jail, and one month after parole. For the 5 years this order has been in effect.

She is one tough egg, she began defrauding the welfare system at 17 years old with her first child. This is a family trait. She knows all of the tricks, and thonmes she didn't know she just learned during her 3 years prison stay.

We have no idea how many children are out there from this woman. All we know is she has custody of NONE of them. MY husband was the last in a long line of men she became pregnant with for support checks. When she loses custody she doesn't want to see the child any longer. They are just paychecks to her.

Now that all of her bad karma is coming back on her, she is pulling some of the most unbelievable stuff to get out of paying. I just can't believe after all the system has seen from her they still allow her to make fools of all of us.
