We purchased a home approximately 8 months ago, and about 1 month after closing roof leaks (visible on wall stains) began to appear. The inpector prior to purchase of the home indicated there was patching done on the roof, but passed the roof as part of the inspection (more to follow below).
The previous owner shrotly after the 1st rain visited to retrieve some mail when my wife confronted him with the leaks we were experiencing. He gave us the name of the roofer, and stated the work was under warranty (odd...don't remember seeing that in the disclosure).
The seller disclosure states no problems with the roof and no prior repair work on the roof. Time has gone by and it additional leaks have arisen (all over the house). Several areas where water stains are now visible indicate where "cover-up" of water stains was previously done (fiberglass meshing now visible along with big brown spots).
I have hired a roofer to give an estimate on repairs and was informed the roof(tile and flat roof) should have never passed inpspection, citing several fundamental flaws and poor patches in the roof. The roofers advice is to replace the roof, however, we both agreed that maybe legal advice should be sought. The new roof is expected to cost between $10,000 and $12,000, and everday it rains, more damage is being done to the home.
Eight months in the home has been so miserable, I wish we would have never purchased. It is obvious the previous owner did not mantain the home, and cut every corner possible when it was necessary.
Do I have enough here to go after the seller, and if so, to what extent?
