What is the name of your state?Illinois/Texas

Okay no one seems to have any answers on here so lets try another question
How does a person proceeding pro-se make and serve a subpoena on persons you need to serve as expert witnesses on your behalf in a child custody "BATTLE"??? The witnesses would be in texas and I need them in Illinois for an evidentiary hearing.

You can start with TX Family Law Code online. I'm not sure as to the procedure re; out of state subpoena. You can also call to get free attorney consults, or help at your local court house in terms of what forms to file.

We really do not give procedural advice here, but I can give you a little practical advice. If the witness wants to show up, you will have an easy time. If the witness does not want to show up, you will have a real battle on your hands.

You may have to put up a large deposit with the court to handle the witness' expenses.

A thought... You might want to research to see if Illinois even actually has subpoena powers over a non-party witness that lives in Texas. Many states geographically limit the distance witnesses may be compelled to travel (such as mileage or within certain counties or entire state).

Subpoena

The persons I need to testify are my son's probation officer, and councilor, I have mentioned to them about travelling to IL with my son and I but I think I have to subpoena them in order for their boss to actually allow them to go , I have not asked them outright to serve as expert witness on my sons behalf as of yet wanted to find out what I may need to do if I am required to subpoena them, the GAL in my son's case has filed a report stating my son's best interest but it is based on no true foundation he has never visited our home in texas nor spoken with persons who could truley state what our
family unit is

These people are not expert witnesses; but you will have to pay a bundle of money to get them to come to your state.

Are you SURE you want a PROBATION OFFICER telling the Illinois court what a good person your son is? He wouldn't have a probation officer unless he had violated the law.

I know sounds a bit strange for someone to actually want a Probation Officer to testify on their behalf, Yes my son did get himself into some trouble last summer, he was placed on probation and since has been a model citizen, this has come straight out of PO's mouth many times, he boost about how well this kid has and is doing that the only times that have brought him cause for concern is when he is visiting his father in IL
this is why I would like him to testify because he says to me, Judge etc... here in texas that this kid has a bright future , I am doing and providing the right motivation for this kid to succeed!

These people can file declarations/affidavits. Then their words and opinions will become part of the court record. Also any documentation via his school records or report cards will be helpful to show if you are monitoring him academically.

Our judge allowed people from out of state to testify over the phone - might be worth checking into that.
