Hi, I live in Ohio and need some advice about a site (whiteovernite.com). I ordered from this site about a free trial for some teeth whitening. It was an offer at one of the Free Ipod sites. On their main page, it states that it is a FREE TRIAL with Satisfaction Guaranteed and that it is FDA approved. The free trial only costs $3.95 for S&H. I proceeded to place my order and briefed thru the Terms & Conditions. There was no "I have read and agree to these Terms & Conditions" box, or anything of the sort. Three days after I placed my order, they try charging my card for $106.90. I used a Paypal debit card, so it was denied due to NSF. I e-mailed them (as they do not list any phone numbers), demanding that they cancel my order. They said that they would cancel in accordance with the Terms & Conditions. In the Terms, it states that you have to cancel 30 days before your next shipment, and as a first-time customer that is impossible. The trial was supposed to last 14 day, and then I would be charged $106.90. They also state that there are no refunds. It also states that the FDA has not reviewed any of their statements. Any advice on what I should do? I don't want a collection agency coming after me for the $106.90. Are the T&C still valid if I don't agree to them and if the company breaks them? They tried to charge me before my 14 day trial was up, and they never shipped anything to me. Any help would be appreciated. Thanks.
