I am asking this on behalf of someone very close to me. 'Mrs. A' married 'Mrs. A' about 11 years ago. 'Mrs. A' had significant assets from a previous marriage, and a prenup was drawn up and signed. However, over the years, virtually every item on the prenup has been converted to marital property through selling and repurchasing a different item (such as one property was sold and another purchased during the marriage exclusively with the proceeds). Every transaction has been documented and recorded to account for every penny covered under the prenup. My question is, will this matter? Will the property be considered marital property even though 'Mr. A' contributed nothing? 'Mrs. A' hasn't worked during the marriage (had no need to due to monthly checks from investments) and has basically supported 'Mr. A.' the entire time. 'Mr. A' expects to receive half of everything-even though he contributed not one dime to the home or properties. Is this just a disaster the judge will have to wade through, or are they more likely to just say it's all marital property and divide it evenly? 'Mr. A' also has a significant portfolio himself, but chose to let 'Mrs. A' pay his way, but now wants half of everything. Help?
