What is the name of your state (only U.S. law)? Utah

I am a mother of 4 and I pay child support for 2 of my children right now to my ex husband. I've been paying for about 10 years now and for the last 2 years I have been current. Well a couple of months ago my ex submitted some medical bill from years ago that I was supposed to pay so Office of Recovery Services took the bill and added it to the balance owing on my account. They submitted paper work to my employer so they would start withholding about $50 more per month from my checks until I am caught up again. Well just last Friday I learned that I have a levy on my bank account. Not just for the amount owing for that medical bill but for current support as well! Can they even do this if there was already an arrangement to withhold this money from my paychecks?What is the name of your state (only U.S. law)?What is the name of your state (only U.S. law)?

Very simply, yes they can.

They can't double dip, but they can try to recover the funds by more than one method.

Right after they got the levy they received 2 more payments from me. The thing that makes me mad is this is my only source of income and I live paycheck to paycheck. This was money I had saved from my paycheck to buy my little boy some Christmas presents! Now I have no money to buy him anything unless I skip out on paying bills.

Example:

You owe $5000 in arrears.

They attach your wages for $50/week. They also levy your bank account and take (for example) $200. Now you owe $200 less, and you'll be garnished for a shorter period of time.

Out of interest, how much do you owe in past support?

I owe $181.53 to be exact. But the levy on my bank account is for $500.00! I don't know what to do and I don't know how to explain to my 6 year old son that there won't be a Christmas this year because the state took all my money.

$181.53 includes everything? CS arrears PLUS medical bills?

(Your first post implies that you've only been current for two years - did you owe arrears for the prior 8 years?)

you don't explain to the child anything. check your local church for toy giveaways. check your local Salvation Army or other family services.

or *gasp* teach your child the purpose of giving to other less unfortunate.

Yes this includes everything. They have already received 2 payments from me this month.

I was current until 2003 when I had complications due to pregnancy and I was on bed rest for 2 months. Once I had the baby and went back to work it was hard to get caught up. I've been current for the majority of the time I have paid the child support. I have actually been current on child support since August of 2007.

Ditto, ditto, ditto.

(don't make me regale you all with tales of my childhood...couple of toys each, a few books, and a few items of clothing...and the next day, we picked one of the toys or one of the books and went to Church where they'd be distributed amongst the homeless/shelter kids. Awesome habit to adopt, is giving.)

Get on the phone and ask them about it. Seriously - ask them for an accounting, how they came up with the number.

So what do I do in the meantime to make sure my son has something for Christmas? I need to know who to contact or what I can do to push this thing through now.

this won't happen in time for christmas. that, i can bet the rest of my cheesecake on.....

It's a little too late for that, and I shouldn't have to because some bitch comes a long and decides to take my money. Easy for you to say these things anyway, I'm sure you've never been in this kind of situation.

yeah....never. uh huh. never paid child support. naw.... never been broke i can't afford to buy toys...naw...not once. not ever. :rolleyes::rolleyes:
