What is the name of your state? IN

My ex-husband was place in Jail last week. My kids were with him on summer vacation. I had to go get an emergency custody order to get my kids back from his current wife. Do I have to give him makeup time when he gets out of jail? Do I have any grounds to refuse him visitation? He owes over 5k in child support has no job is about to lose his house, and is going back to court the beginning of September and possibly facing some more jail time.

what did he go to jail for? and no, he went to jail due to his own voluntary actions- he was unavailable to use his parenting time- you do not owe him makeup time

Which has nothing to do with the safety of your kids so you cannot deny him parenting time when he gets out of jail> You could always try to petition for a modification but you don't have good cause -- the children are not in immediate danger and it is not as though he has an order of protection against him for his wife's minor son.
