What is the name of your state?California

Our court order states that my ex picks up child from daycare at 5:30pm. I
am off work in time to pick up my child straight from school. I then drop my child off at daycare by 5:30 on my ex's visitation days(ex refuses to pick up from my house) My ex just stated that he spoke to my child's daycare and school and I will not be allowed to pick up my child from school or drop him off at the daycare prior to 5:30pm. Will they enforce that? COurt order states anytime child is not visiting father is mother's time. I have physical custody. Can he do this and get away with it? :eek:

Well.... here's a question.... How is your son acting on the days you pick him up from school and then drop him off just in time for Dad to get him?

Actually no, I don't believe that he can. I can't imagine that a judge would order your child to go to daycare on days that he doesn't NEED daycare...just so your ex can pick him up from there...instead of some other neutral exchange point.

Stealth is making a valid point about your son's reaction. However basically your ex is demanding that your son be sent to daycare needlessly. That doesn't make sense to me and I don't think it would make sense to a judge either.

Do you have a "Right of first refusal" or some such stipulation in the court order? (Where the avail. parent can have the child before any sitters/daycare)?

I'm wondering if the daycare has some issues with liability for a child that is not under their care being dropped off and there until dad arrives, even if only a few minutes. I wonder if there are liability/insurnace issues with day care being the interim responsible party even though they are not acting as the caregiver at that time?

My son is fine with being dropped off right before dad picks him up. He prefers that I pick him up straight from school so he can come home and relax a little, have a snack etc. When I drop him off at the daycare he plays with his friends until his dad picks him up. I pay the day care to watch my son in the afternoon. So they are insured from the minute he is signed in until he is signed out. The daycare is one big room on school site, so playing in there for an hour or so is fine but three or more with graham crackers or such for snack and only being able to walk to the bathroom(not in same room) at certain times seems ridiculous to me if unless necessary which it is not. Father has to pass my house to get to the daycare.

Also, alot of you know how day care is, specific times, specific days.
Unless necessary (Dr. appt or some emergency) I can't show up during nap time to get my little guy.
I must pick him up by 6:00 oe be charged $1.00 per minute afterwards. be there between 7:00 and 9:30 am.
Such a mixed up schedule may make the day care decide not to keep child enrolled.
