I am looking for help on this matter... My husband and I bought a mobile home from an independent sales rep here in Georgia. He sells repoed homes.. This man preys on people with little or no credit. We are not the first victims and certainly won't be the last. The house was not set up properly, the skirting is not on (all i have is plywood and chicken wire), the trim is popping off the walls, you can see the ty downs throught the ceiling, the middle is noticeably coming undone, the bathroom walls were not caulked so the shower stall pops out, this is only a few of the things that are wrong.. he has been notified by us several times about the problems.. all we get is a "really?" and "we will be out there" no one shows up at all. I called the building inspector here and he told him what he had to do.. he had a guy out here for a week trying to put footers down the middle (havent seen him in a week and a half) my house is caving in... Due to it being a repo, the fire marshalls office can only deal with the set up... I have had a hard problem getting an attorney who wants to deal with this problem. What else am I supposed to do here? who else can I call? This guy talks his way out of everything and gets away with robbery. He is stretching this thing out on our warrenty.. Anybody help me? Any attorneys?

Are you willing to walk away from the home? If so, sue seller to rescind the contract. He gets the home back and you get your money back, although the court may credit him with a "reasonable rental income" on the home. To rescind the contract, you'll have to argue that the limitation of remedies in the sales contract have "failed of their essential purpose." If you can establish that, the court may give you rescission. It may just reduce the contract price. You'll need a contracts attorney.

Also, report seller to the state attorney general for fraud & unconscionable contracts.
