What is the name of your state? KS
OK... My daughters biological father was not a part of her life from the time she was 2 1/2 until now.. She is 8. She has always used my last name but it is not the name on her birth certificate. All 'legal' paperwork has her legal last name on it. Now, her bio father is telling me that it is against the law for her to use my last name. He says that it is 'falsifying' her name. I don't think this is true.

In a sense he is correct. What name has she used during school because she is to use her LEGAL name. As far as it being against the law, I cannot state for sure without looking up the statute, but it's stupid. Why would you teach your child to write their name a certain way when it's not their name and she will be required to use her LEGAL name that is on her SS card once she begins working and such.

I didn't 'teach' her to write her name the 'wrong' way. I taught her what her last name was and what the rest of the families last name was. She chose on her own to use the last name of the rest of the family. I just didn't correct her as I didn't see the harm in it.

HUH? You let your child CHOOSE her last name... Dang, I bet every kid wants you to be their momma!!
