I've been separated from my husband for the last 11 months and have been supporting myself and 3 kids on my own. I've been told that i should file for a legal separation until the divorce is filed for. Which i agree with wholeheartedly. But my problem is that i don't know how to go about filing for a legal separation. I don't have a lawyer because i can't afford one. And i'm totally ignorant about the whole process. I live in the state of Georgia and if you could give me some advice i'd appreciate it. Thank You.

My response:

Unless you have some sort of Religious "thing" against divorce, don't waste your time with a "legal separation". The process is the same as Divorce; the only difference is in which box you check on the form Petition. But, if later on, you want a Divorce, you'd have to start the whole process over again. That's a waste. Just get the whole thing over in one filing. Start and end with filing for divorce.

Since the Divorce (or Dissolution of Marriage) process is long and complicated, we couldn't possibly "walk" you through the process on these Boards.

However, depending on your educational level, and if you have a basic understanding of law, you might want to try getting yourself a "Self-Help" or "How-To" book on the subject of Divorce from a major bookstore.

There are many pitfalls, so be careful.

Get a lawyer and find out the laws.Because your husband can screw you up if you don't have a lawyer.You got to have a lawyer to depend you.In the state of South Carolina we have to be separated for a year before we can file for a divorce.It'll cost you some money,but you got to do it for yourself and your kids.

She's talking about obtaining a "legal separation" - - not the mandatory separation period before you can Petition for a divorce.
