My Grandson's Dad died when he was 2 months old. My Daughter has had full custody of him since the day he was born. Yesterday the Paternal Grandmother served my Daughter with custody papers. My Daughter is a great Mother so there is no reason to doubt my Grandson is being taken care of. On the other hand the Paternal Grandmother is mentally not fit to take care of him due to depression and other reasons, she is taking several prescriptions and we are very concerned for his safety when he is with her. Does she have any legal rights to him? The court date is in 3 weeks, what should we do to prepare for court?

'Custody'? Not unless Mom is proven unfit. 'Visitation'? Very likely. Specifically with a deceased Parent scenario.

You say that you are concerned about his safety "when he is with her"...that implies there is an existing relationship, which also helps her case.

How old is the child now? Can you prove she is a direct danger to the child?
