What is the name of your state? Nevada :confused: I need some kind of help on the best way to handle my situation.Ok here it is... I have been with my boyfriend since February 2000. He is from Mexico and was not here legally. We have two daughters together 6 & 3. In February 2006 he got put in jail and I hired a lawyer he charged me 800.00 just to show up and sit there in courthouse and get a voluntary departure. His assistant made me feel as if would be coming home very soon, let me add that I felt that I was ripped off I could have saved my money and just let him get deported.Anyhow finding it hard for myself as well as our children to be with out him I found me a job in San Diego,Ca and moved to Tijuana,Mexico. Did that for a year the my Mother had some health issues so my girls and I returned back to Las Vegas. An have been back here since March 2007. Still missing Daddy. I have decided to marry him (after all this time). But he is still in Mexico, do I have to marry him down there or how can he get here legally to marry here. I do not know what to do or how to do it i don't know what steps or forms to to fill out any advice would greatly be appricated. My girls and I need him back in our lives, It's too hard just talking on the phone every week.:)

As far as I know, a Voluntary Departure is --much-- better than a deportation, especially as you want him to come back.

I am guessing that you want him to live in the US with you? Or do you just want to be married?
If you want him to legally immigrate, I recommend that you use the forums at www.immigrate2us.net instead. They are well versed in dealing with EWI, VD and the other issues you've got. You can also find out if it would be better for you to petition for your BF as your fiance instead of spouse.. the visa interview wait time from Mexico is much much shorter for K-1 fiances than spouses.

Yours is not a straight forward case, and you should get your moves checked out by an attorney before you file anything.

THANK YOU SO VERY MUCH also I want him to live here in the states with myself and our two daughters as we once did. I will check into the site you told me about as I know nothing about any immigration issues.
