i have a question to ask. the apartment that i used to live in was getting rundown and i told the landlord if he would fix the apartment i would pay the rent. he never did and i owe him back rent because of this. i never had a contract with him and i lived in that apartment for 10 years. now he has found me and wants me to pay him. but i have no money right now cuz i just recently bought a trailor because the apartment was to rundown. i live in north carolina and i was wondering what he could do.

You have nothing in writing, so how can he prove what you owe?

Also most state have a stale rent law, which means if a landlord does not ask for rent or try to collect for 3 to 6 months, then ALL back rent is forfited and the landlord could seek only the last 3 to 6 months rent..

Its that he is broke and is trying to screw you because YOU GOT UPPITY and bought your own trailer...

And your a Woman too boot... He is a southern redneck and thats how they think!

How can he sue me if I do not have any money or property for him to get? I did do a lot of repairs in the apartment which he never refunded me and also he had the roof repaired and the old shingles were never gotten up and I paid someone to get them up and remove them from both sides of the complex apartments. I went without a kitchen light for several months and had to use a lamp from the living room until I could get enough money together to have the light repaired. The place was unlivable and I told by several people to contact the health department because of the condition that it was in.

He can sue you and have a judement on your credit record for 10 years, so if you do get any money, they can come after you....any money....even if a relative dies and leaves you a little it can be seized...And NOW you own a trailer a lein will be put on it, and the lien would have to be paid before you can sell the trailer.

You will learn a valuable and EXPENSIVE lesson from this:

You were POOR, and POOR people do dumb things like spend their money on fixing up the landlords house WITH NOTHING IN WRITING!

These REDNECK landlords lie and wait for suckers err tenants like you. Becuase they need the money for drinking drugs or a mistress, thats why they have ZERO money to fix the house up.

I do not own the trailer yet. I have to make payments for 14 years and 10 months. As for the family part, I do not have any relatives that are willing to leave me any money. They have disowned me because of a family situation.

Well there is life insurance, bank accounts, stocks personal property on your parents or other family members and especially if they die without a will...then you would be entitled to a share...

So if any of them want to make a will.. DISCOURAGE THEM, beacuse with nothing in writing to disown you, you would be treated as a equal family member...NEAT.. KEWL!!!

And..Yes they will put a lien on the trailer, and any "equity" you build up over the next 15 years, will be used to pay the lien, when you sell.

I am on my own and my parents are deceased. The only family I have are my two children because I am divorced.

The way I understand it...in MN anyway. If there is a problem with the unit you are renting you put your rent into an escrow account which the landlord gets AFTER the repairs are made. Enough said?

well if you have any brothers or sisters if they died you would be entitled to a share as well.

well what do you think the landlord wil sue you for? back rent how much? and what dates are we talikng about?

sounds like the landlord has NOT gone to court and got a judgement against you... so how can you owe him any money?

What proof do you or he have?

He has no proof because there was never a contract between us and he kept telling me that if my son would help me out and fix things up there would not have been so many repairs to be made. I owe him for several months from 1999 until now. But I called him and told him if the repairs were not made he would not get paid. The whole apartment was falling apart. The brick wall on the outside had a big crack in it, the concrete steps on the front and back was crumbling to pieces, the plumbing went whacko, the nails that were holding the fountain was coming through the walls,termites was eating away at the woodwork, the disappearing stairways was coming apart, the kitchen light fixture burned out, the commode did not have enought pressure to flush the first time, iron railing on front porch came aloose from the brick wall, he had old stoves, refrigerators, air conditioner, washer and dryer in the basement, the floor in the living room had separated from the doorway, the wood in the front door had split, both storm doors on the front and back door would not lock, the heating system was not working properly and in the attic the roof was not completely all the way down to the woodwork because you could see separating places where birds and squirrels came in. Thanks for all of your advice. I do have two sisters but we have not spoken to each other since September, 1998 and they have acknowledged that I was not a part of the family and that nothing they had would be left to me when they pass away.
