What is the name of your state (only U.S. law)? I am in alaska. I need to know if I am in a halfway house can I get visitation rights? I also need to know if the mother can change her name with out my consent? Can anyone help I would greatly appriciate it, thank you! I am on the birth certificate. Other than that I am not sure, I have not had a parunity test done but, I am not contesting I am the father. I am going into a halfway house for a criminal case, DUI and I have already done treatment.

Have you been legally established as father?

What kind of halfway house - rehab? probation? criminal?

Give us some more details and we'll be glad to try and help.

How long are you going to be there?

You need to file with the court to legally establish paternity (if this hasn't already been done) and to set up custody/visitation but be aware that visitation might not happen until you're out of the half-way house.

With regards to the name, are you talking about the mother's name, or your daughter's name?

(I ask because you never made clear the gender of your child and I'm only assuming you're talking about a daughter, k?)

6-8 months then I am going to get back out on ankle moniter. My daughters mother wants to change mydaughters last name from my last name to my daughters moms last name.

getting visitation isn't so much the problem. it's getting the place for the visitation. is it safe to assume your half way house doesn't allow overnight guests? how about day visitors?

could you be released to attend a children's visitation center for supervised visits?

mom cannot change the child's name with out your permission. it may be possible a judge can add a hyphen to the daughter's name with mom's name added to yours.

If the halfway house allows visitation, and if mom agrees to bring the child there for visitation, no problem. If mom does not agree then it will be up to the judge to decide whether or not its appropriate for the child to visit you in a halfway house.

The judge may agree with you.

He may, but I'm not seeing it - not in Alaska. I honestly think it's far more likely that visitation will be at the very least postponed until Dad is no longer living at the half-way house.

Timing is problematic too since he will only be there for 6-8 months. However, since we don't know anything about the halfway house and the overall calliber of people who live there, I wasn't willing to guess which way it would go.

yeah your probable right there, I guess I will just have to wait then, I am glad she can't totally change my daughters name though, well I appriciate all the help, Thank you so much

In the meantime though, you should get the court process started since that can take some time. Either hire a lawyer to start the filing process, or get some books on Family Court processes and procedures and learn how to do it yourself. I am assuming you have some time on your hands :) And some of the other posters here can probablys suggest some web sites and/or books for you to start your research.
