I own a house with a guest house on the property in NEW YORK, my mother has the right to live in the guest house as long as she wants, she is NOT on my deed as a life tenent we do however have a written agreement stating she could stay there, she left last July took her clothes, old coins, jewelry, anything of value and moved in with her boyfriend, she does come back every couple of months for ONE night! Question: My brother who has been treated for suicide and drug addition is coming to visit with a friend, Its my understanding that my mother is going to let him in the house and let him stay there (she will not be there). I know that he will have his drugs with him, (as sure as the sun will be up), What should I do? I have already spoken to him about bringing drugs, If he has them do I have a right to tell him to leave? Or is my mother allowed to have ANYONE stay whenever they want? Hw will be here this Friday so if you can help that would be GREAT!

You need to check whatever "written" agreement you have. She may have a right or license to occupy the property BUT may NOT be able to assign it to your brother.

Get legal advice and then have attorney write mother at boyfriends home that she can continue to live there, but can't let other people live there.

You need to rachet UP the legal situation since she appears to be attempting to maintain the "spirit" of the agreement to maintain control.

Thank you for your reply.
We have on going problems with my mother, as I said she changed her address and has not "lived" in the house except for one or two nights a month. My main concern is my brother staying there for a week or so and bringing drugs into the house.
If need be I will call the State Troopers, As my husband are both upstanding citizens in the community, we both volunteer with the local rescue and fire dept. as well as being involved in the school system. I would hate to have my brother sitting in front of the house smoking weed!
