My Daughter is in Dance class and has been for the last three years, and we always help the teacher out with parades and such. Well the last Parade we were pulling our trailer with our fourwheeler for the Dance school. We were going down the road a lady came up with her Kids late, my husband stopped the float to let them on, They got on and my husband said os everyone on and everyone said yes it is clear. Well he began to take off and the lady decided to get back off, she fell and the trailer ran over her ankle and broke it. She first went for the Dance School Insurance but it had expired a week b-4 the accident, and now she is trying for ours. Are we responsible?? We have plenty of witness's that seen her get off after she told him it was ok to go. But we dont no if that will matter in court. Was he at fault just because he was driving the four wheeler??

Good thing you have liability insurance. Your auto insurance company has specialists that handle dozens of these cases a month.

Whether you husband was at fault or not really depends on the exact facts and circumstances and that is something the insurance company will analyze, decide if it is willing to make an offer to settle, and if so how much, and the woman will decide to accept it or reject it. If the latter she will file suit and the insurance company will defend you to the limit of your policy.

If the case is not settled before trial (95% are) then a jury usually decides who is at fault (if fault applies in your state) and if you husband is, whether the woman herself was also at fault, and if so, how much or who was more at fault, if it gets that far. ANd it decides the measure of damages (beyond medical bills) she gets, if anything.

Let them handle it and be grateful that you paid those insurance premiums, and stop worrying. Accidents happen.

PS Take out an umbrella policy also from here on in.
