I was wondering if the buyer of a car I sold had a case? I sold an 1986 High Performance vehicle to a gentleman in Tennesee. I started out selling the car on E-bay, this is the time in which the buyer contacted me. Through ebay I clearly stated the car was being sold as is. He asked about condition including rust on the body and undercarriage. I replied saying that there was no rust, this was to the best of my knowledge. The car is in overall great condition, if you would like to look at it go here My Car . He also emailed me wanting to know my reserve price for the vehicle which at that time was $9,000, he replied saying it was out of his price range. The car never sold through e-bay, and the buyer contacted me personaly offering $5,850, I declined at the time but stated I would keep him in mind. Due to the season and my debts I decided to drasticaly lower the price and offered the vehicle to the buyer for $6,200. He accepted my offer. Before the transcation even began I sent him an e-mail which I saved, stating the engine specs, the mileage, which was over 100K miles, and advised him once again the car was being sold as is. I also told him that he could come and take a look at the vehicle any time he wished. He did not reply to my offer to come see the vehicle but was still interested in buying the car. After the payment, title transfer, and shipment of the car were done, I recieved an e-mail from the buyer stating that he generaly was happy with the vehicle but could not do a check on everything due to rain. The next day or two, I recieved an e-mail from the buyer stating how disapointed he was in the car. He said that there was major rust on the doors and undercarriage, so much that there would be a $1,400 body shop bill and wanted me to send money back for the bill. When I recieved this e-mail, I spoke to my mechanics, and they both agreed that the car was in great condition and could not recall such rust damage on the car. They both said the buyer recieved the car for a very good price. I then sent him an e-mail stating that I sold the car as is, and did not know anything about such damage. I also informed him I would not be sending any money back. I droped the price of the vehicle down a lot from my first offer. He then e-mailed me back saying that he was going to take legal action for $1,600, does he have a case?

No, as-is means as-is. Not your fault he didn't inspect it first. Not to mention if he lives outside Ohio he'd have to sue you there. Just keep copies of your ebay auction and emails (that say as-is) and don't worry about it.
