What is the name of your state?GA

Just wondering about a few things. I had to get on state assistance a while back and they had me fill out some paper work for CS. Well, good ol RD tells me he's going to start paying CS. Well surprise to me he doesn't pay a dime, hasn't in over a year and now i'm wondering if the information i gave them made me a CS case.

They couldn't find him to serve him papers cuz he's good at dodging his financial responsibilities (I saw this coming). therefore, no order has been set.

I can't afford to get an attorney to go to court just for CS, not to mention the deadbeat is back under his rock at mommy's house in AZ. So could i just go to CSE and give them as much info as i can and open a case that way?

Also, would i be able to call OR where his CS for his other 2 is over $50K in arrears and let them know his wareabouts? His children deserve that money and his ex wife has done a bang up job raising them on her own.

I would like to make him start paying for his "obligations". I have finally been able to see him for what IAAL has seen him for all along.

Oh yes!! Call the other mom and give the info and then call CSE and give them the info....good luck to you both!! :)

Hey thanks. I was hoping someone would reply. I'm just tired of struggling and listening to him whining about not being a part of his kids's lives, yet does nothing to help support them.

Just remember that since you were on state aid, they will take any CS paid by him to repay what they gave you. They gotta get their slice of the pie first. :(

Hey, it's me. LOL Yeah, they can still open a case for you. Just give them as much info as you can and let them know about the other support order. Part of CSE's job is to help you locate the parent. They won't be able to order anything yet, but they can go ahead and open the case and get the ball rolling.

It just seemed to me that they didn't want to do any of the work. They expected me to find him in order to have him served. Said that there is nothing they can do if I don't know where he is at.

Is there anything thing else i can do to help get an order sooner.

You might want to print this up.. http://www.acf.dhhs.gov/programs/cse/fct/cshdbk.htm and give it to them and tell them it is their effin job to locate parents! That's what the parent locator service is for. Tell them to use it. Don't let them screw you. I'd get the name of the person who told you that and then tell them you're calling the head CSE office and report them and let them know what a "great" job they are doing over there and let them know you're contacting your legislators about it immediately. Then email them or call their office and let them know what's going on. You know they get grants, and if they don't do their jobs, they will lose those grants.

Give them his parents address and have him served there.

I'm sorry but that just burns me up! :mad:

You should tell them since you know the laws, policies and procedures better than them and aren't lazy like them, maybe they should give YOU a job there.

How does that work in GA? The part about paying back the state? I know in NC, they will order additional money be paid to the state. Like, if CS is ordered to the CP at $200 a month, they may tack on an additional $15 (or whatever) a month to be paid back to the state. So that would bring the monthly total to $215 a month. The $200 will be sent to the CP and the $15 goes to the state. I don't know what type of forumlas they use, just know that they do it like that so that both parties get money. Just curious how they do it there. :)

They may allow her to keep $50 of whatever is ordered (this is called a "pass-through"), but anything above that will generally go to the state to pay them back for the aid she received. Once they're paid back, then she'll start receiving the whole amount ordered. If the CS order is issued from AZ (RD's state) then they don't have a "pass-through" or disregard amount like GA does and she won't get anything at all until the state is paid back.

When you apply for the aid, you effectually sign over all of your rights to child support to the state. Some states have pass-through amounts and some don't.

This is a wonderful site I've tried many of the laws BUT. When I mention part of it to the case worker I am told that due too new Privacy laws since 911 they can't even look into the DMV for her drivers licence for an address. I had to go infront of a Judge to ask for a subpeona so the caseworker could look into her drivers licence for her address. I've been given the patriot act and new privacy act quote nearly every time I ever ask if she was located. She's given 17 bogus addresses in four years, several times to a Judge.
The Judge did give permission for the caseworker to issue a warrant without her address after I had to go to court to prove I tried all meens to contact her. Well the case worker still hasn't signed off after more then a month because she's never heard of such a court order without notifing the deadmeat mom.

I got tired of dealing with the Tx OAG and started writing, not only my state representatives, but my US rep and Senators too. The US senators were the most help. I had a letter and email from the OAG with in two weeks of Sen. Kay Bailey-Hutchinson's return letter to me. The ball has been spinning along nicely ever since.

Email your Congresspeople! Can't hurt.

45Frank, you need a new caseworker!!!!!!!! A judge said to get a warrant issued and your caseworker's not doing the paperwork???? Who's the boss over there??? YIKES!!! First, I'd DEMAND to speak to his or her supervisor. Second, I'd DEMAND to be reassigned to someone else!! Here in PA, the caseworker draws up the motion for a bench warrant, presents it and the judge signs it. They do it differently in your state? I guess I'm not understanding why the judge didn't sign something when you were there to get the warrant issued. :confused:
