What is the name of your state? Florida. Been monitoring this forum learning tons from. I wanted to share my experience and hope it may be helpful to others.
A special thanks to Lady in Red, Bigun, Jetx and Debt Guy, and others for your expertise and willingness to help others. You are l my hero’s. Because of your input, I’m very grateful, as I was brave enough to file pro se before the law changed in October.
Two weeks prior to my 341 meeting, I got a letter from the trustee saying that if I did not amend my schedule I & J they were going to dismiss my bankruptcy under substantial abuse. I had made a BIG mistake and had not listed my two children on my form. So my expenses were too high. Yikes! They demanded 2004, 2003 tax returns, W2’s, bank statements, yada yada! All by Dec 9th, less than three weeks! Needless to say I had trouble-sleeping waiting to defend myself as I can not afford an attorney. Meeting was this past Tuesday.
I filed the requested amendments right before my meeting. While waiting for my turn, I saw plenty waltz right through with no hassles at all. Rubber stamp…meanwhile I notice a man that looked like an attorney, or collector waiting.
Next, a married couple was called and he joined them. He was the US senior trustee and was challenging their case. I knew, I was next. Sure enough after he was done with them and a few others where in and out without any hassle.
They call me up, and there he is again. When they asked if I had any help, filing I said no. He asked how did you know how to fill out the paper work? I said I tried to follow directions, but I made a crucial mistake and could have used some help. He said I needed to explain myself. I launched into my not listing the children and further explained why and how long I struggled before filing because I never wished to file even though I was told by my divorce attorney I was a prime candidate 5 years ago. When I finished, the US senior trustee asked if I had filed the amended schedules with the clerk. Yes. He said he no longer had any interest in my case and I know longer needed to send them anything and he would send me a letter to that effect. Stunned, I thanked him. We were done.
I walked away and everyone waiting to be called were all smiling at me. Unbelievable. It may take me days to recover from my stress, but I believe I am done. Many thanks to all. I am now hopeful that I’ve already had my share of drama. I never wish to go through this again.
