Ok try to make this short
Niece is living with me Temporally mom relocated to another state she gave me notarized paper to get her signed into school and deal with school issues until she is settled and can send for her.

Niece made the cheerleading squad (grandmother paid fee $350.00 Appox)I signed and returned all paperwork sent home and everything has been great! Until my niece was at practice at the school when a stunt went bad and another girl fell on her and my nieces nose was broke, took her to the emergency room and they referred her to a specialist on Thursday (accident happened on a Wed) the doctor says it is pretty bad and she needs surgery and needs to do it on Monday but not until someone takes financial responsibility (nieces nose is pointing toward cheek and in a lot of pain) After the appointment we took our niece to school to pick up books etc...for homework And the coach ran up to her and gave her a form (Athletic Participation information and Authorization)see attachment and said it needed to be filled out by me before she could return to Cheerleading also that she needs a physical.

My niece has been at every Practice and cheering at games for approximately over 1 month and there had been no mention of either of these forms.

The coach had neglected to hand out these forms and or make sure they were returned not only to my niece but several other girls on the team (and now they are benched until the forms are filled out) I do not have children of my own in sports and completely filled out and returned the forms that were presented to me and now they are saying it is my responsibility to have known this was needed and are refusing to take responsibility for the medical bills (if I had known this im sure grandmother would of purchased school insurance I found out after the fact was available) and this would of never been a problem.

I understand their will and can be accidents and the child that landed on my niece is at no way to be blamed for this. But shouldn’t I have been giving the opportunity to purchase insurance prior to this accident??

So my question is the school responsible for paying these medical bills, we don’t want anything else at this point just for my niece to be out of pain and her nose put back were it belongs in a timely manner (the longer we wait the more pain she is in and will be in once this surgery is done) I am not wealthy and do not have the funds they want up front to have this done.

If this is drug out and my niece is having to be is pain for a long period of time because of them not wanting to take responsibility should I go for pain and suffering and future medical problems that arise later?

by the way the meeting at the school with the athletic director and head coach did not go well although they did admit these forms were not filled out or recieved they say it was my responsibilite to make sure they were even though I new nothing about them.

What is the next step I need to take to get this resolved??
