My divorce was granted in Utah. My daughter now lives in Colorado. The divorce decree awards "joint legal custody" with custodial responsibility to the mother. My daughter's mother has enrolled her in an alternative school. The regular High School did not request she be placed in the alternative school. The school counselor was not involved in the decision. There was no attept by the school to plan an Individual Education Program (IEP) to meet the needs of my daughter as required by state law prior to removing my daughter from main stream public education. I do not beleive the special school is the best approach for my daughter.

What are my rights?

Can I force my X to get my consent for decisions regarding my daughter's education?

Can I force the school district to develope an IEP for my daughter?:confused:

As to your second question, sure. But, how much money are you willing to spend on an interstate custodial "decision" dispute ? Where's the harm to your daughter? What were the reasons given for placing her in an alternate school ?
