I was at a clinic for a day of testing and was told to talk to the Doctor (resident) at the end of the day. I was in a full waiting room with around 20-25 other people including my brother. The resident came out called my name and came over and in a loud vioce started to give me the results of the test. I was so horrified by this lack of care I barely heard what all he said. My brother was also appalled by this behavier.

Am I being oversensitve or is this a classic HIPPA vialation.

If your confidential lab results were given to you in a voice loud enough for the rest of the people in the waiting room to hear, it was a violation. However, because you were present and did not ask to be given the results privately, it may be considered implied consent.

I'm medical, not a lawyer.

It sounds like a HIPPA violation, unless you signed something agreeing to let them do this. However, HIPPA has no private cause of action. That means that an individual cannot sue an agency, hospital, school, whatever, only for violation of HIPPA, which is a federal law. You can sue them, however, for the usual things and in this case it might be a state law tort of violation of privacy. I suggest that if this happens again, you immediately stop the person and suggest that you both go to somewhere more private. That's much easier than a lawsuit.

Damn it, it's HIPAA, not HIPPA! Why is no one capable of getting it right?
