Hiring in the middle of Bankruptcy

Hello to all and Beth:

On a personal note, my parents are in the middle of filing for Chapter 7 and are ready to sign the docs soon to start what I guess are the proceedings. My dad who is 74 and is still working 30 hrs a week at a golf course is in the hospitality industry as a waiter/bartender. Once he files he should be able to cut his hours significantly since this should eliminate about 1300.00 a month in debt that has festered for a very very long time. My Mom's spending habits!! She has stopped with the credit card spending but the damage has been done in the past 20 years. Can my Dad apply for employment elsewhere without being discriminated for bankruptcy?

Hi, Al. Sorry to hear about your parents' situation.

Your dad's bankruptcy filing shouldn't be a problem unless he's applying for work where his credit history is important. Much of the time, an employer doesn't even check that but it depends what type of work he's applying for.
 
Dad's bankruptcy

He will be applying to a Perkins Diner Restaurant and I know the Manager there somewhat. She is the one that told me he should scale done his hours and they would like to have more seasoned people on staff. He could practically name the hours he wants p/t. As far as his bankruptcy, I actually feel in my heart this is the best thing for my dad (74)... a new beginning. This battle with my mom's credit card spending had to go away somehow. Between the cards and credit line(s) it was up to 50K which was being paid via pension/S.Security. Luckily at least they have a house worth around 165K, however they currently owe about 140K in mortgages on it. In a nutshell, they have been living paycheck to paycheck. If they ever fell short I would help if necessary. They have been paying everything with cash the past 2 months however and managing actually quite well. Thanks for your input and take care my good friend. I feel like I know you for years. You are a lifesaver and help me in ways I can't even express in words. You give me the confidence in certain dealing that I have and I greatly appreciate your intelligence and help in the past as well. :)

You're very welcome. Glad I could be of help. :)

I've never worked for Perkins but I'd be very surprised if they ran a credit check on your father as part of the pre-employment process for whatever part-time job he's pursuing. And even if they did, I'd doubt it would bar him from employment unless he's going after a store manager position or a job in their finance department. Hope all works out well.
