Hit a parked car on the street

Alright, this story actually did not happen to me, but to my sister-in-law. Just trying to get her some advices from other people. Last week she went to a bar with her boyfriend and some other "friend" of his. She did not drink that night, but her boyfriend was drinking so she took him home and other guy, at that moment they thought he was a friend, asked for a ride home, since he was drinking as well. So she took him home.
Half way there he jumped on her and tried to rape her. The car swinged to the left and hit a parked car on the street since he hit her and she had no control over her car. Then he stolen her wallet and ran away. She called the police. After police officer arrived and she told him the story - they tried to find that guy at his house - but he was not there. Then police officer said in exact words "I have to charge someone tonight" and charged my sister-in-law with hitting a parked car on the street.
Honestly, sounds retarted to me... Is there anything she can do now? She definetely cannot afford both car repairs (deductibles) and her insurance will raise now, since police assumed her at fault.
I guess for a question what to do with an idiot that was trying to rape her I need to go to different section in this forums, but if someone can just answer here that would be great as well.
Hope to hear some advices, cuz she is totally lost right now.

Okay, here we go. Please do not post this in other sections. Your post will be read, right here. Its much easier if all of the questions/answers are kept in one thread.

The police officer was right to charge her. Its unfortunate, but he was right. She was the driver of the vehicle, therefore she is responsible for hitting the parked car. Now, she can sue the "friend" if she would like.

She does not have to pay 2 deductibles. She will pay 1 deductible to repair the damage to her vehicle. Her property damage coverage will repair the damage to the other vehicle. There is no deductible for property damage.

Her insurance is going to be responsible for paying for the repairs to the car she hit. There will not be a deductible for this (I've never heard of a deductible on liability coverage). She can go through her insurance to get her car repair and sue the guy who attacked her for the deductible. Her insurance may also try to go after him to get back the money they pay out for the accident (both cars). I do not know if she will be considered "at fault" for the accident...she was the one behind the wheel but obviously there were extenuating circumstances. She may want to consult with a local attorney for advice.

Well if her passenger really did attack her, I'd say that is a legitimate extenuating circumstance. Charge the guy with attempted rape/assault and see if you can get the ticket dismissed.

I understand your sense of humor, but she has a report stating that she have fresh numerous bruises all over the body from that guy trying to rape her. I would like to see your face if that would happen to your wife for example, if you find this funny or you think she is trying to get away from higher premiums.
People come here for an advice, not for stupid comments that make their day worse that it already is - you can do this somewhere else.

Now, for people that actually did answer the question.
How should she go around sue that guy w/o paying for an attorney? If possible with details.
