We live in a an 8 unit condo complex. Air conditioning is not addressed in our CC&R's and is typically not an issue in our area. However, the Homeowners Association approved the installation of an air conditioner for one of the units with an exterior wall about 10 years ago. The A.C. unit was installed next to the unit in an area that blocks noise and is not next to any other homeowners.
The problem is that another homeowner has now informed the HOA that he plans to install an air conditioner. The homeowner's unit is one of two interior units in the compex. It has common walls with neighbors on each side and opens to the community recreation/pool area. In good faith, the HOA has taken time to consult with experts to try to locate an installation location for this homeowner. Unfortunately, the only options are the decks or an area under the deck of another unit. The roof is not a viable location due to warranty issues. There is no location that would not directly affect neighbors. People purchased in this community so they could keep their doors and windows open to enjoy the cool ocean breezes. Utimately, if the HOA approves the installation of the AC, the quality of life and propety value for the adjacent owners are at risk.
Therefore, the dilemma is does the HOA have to approve AC installation location for this unit? The owner says we do since a precedent has been set. Help!
