I own a house in Florida. I got a little behind on my HOA payments, but after about a month or so they ended up withdrawing the money I owed directly from my account and the amount for the next period, and therefore am at a $0 balance with my HOA. A few days later, I get a notice from a collection agency that is threatening to place a lien on my property unless I pay them the amount that I used to owe to them, fee for a certified letter and $300. I contacted them to inform them the debt had already been paid, and they replied to me with this:
At the time of notice the account was past due and authorized. I discussed with management and they stated there wasn’t proper notification of ACH setup to prevent the file from turnover to collections and payment was processed 4/3/17. The notice is an intent to lien, and a claim of lien has not been filed. In terms of the other costs, our office is willing to negotiate the fees to resolve this swiftly and amicably. The other costs listed on the letter include all collection fees/costs along with a management transfer fee totaling $300.00. Please make an offer towards these fees/costs and I will seek approval.
Their reply has me confused, because I feel like I don't owe any money, but I don't know if they have any legal recourse. What should I do? Any help would be greatly appreciated. Thank you!
