My HOA wants to increase the dues from $185.00 to $190.00 and also are requesting a special assessment to paint the condos(80 units)Can they forclose my property if I refuse to the increase and the assessment?. I belive it is too much money for the services they provide. Landscaping is poorly maintained and the condos. have not been painted since some 20 yrs. ago. Can I request the HOA Board to change propertymanagers?

Read all your condo docs, last 2 years HOA and Board meeting minutes, reserve study, financials etc. Based on the need for a special assessment and the present condition of the common elements, your project has a reserve problem. If you do not pay the increase in the dues or pay any other prorated condo expenses, the Association may have lien rights and may be entitled to foreclose on the property. You as an owner can request that the Association change property managers. The management company may not be the cause of the problems. If the reserve and operating expense accounts are too low, funds must come from the condo owners. This needs to be accomplished no matter what property management company is hired.
