My wife is going through a very uncomfortable custody battle with the father of her 5 year old kid. In January it will be a year since the beginning of that process and they haven't even had their first conciliatory meeting. My wife is very scared of this guy's next reaction, which at the same time feeds his disrespect and abuse against the visitation terms. After months of discussion, she finally got a restraining order against him, but the guy kept calling and harrasing. I have tried to stay away but I can't stand his disrespect to my wife and kid, so I started recording all his calls, took them to the police, and he was finally convicted to one year parole. But my wife is still afraid. Yes, it's unbearable to be in the middle. The guy has a history of drug abuse, emotional unstability, can't hold a job for more than 3 months, at 31 still lives with his mother and stepfather and still my wife is scared of losing her kid's custody essentially because of the expensive lawyer this guy's mommy is paying. The guy was ordered a drug test as a petition from my wife to prove he's still doing drugs, which he denied in court under oat a month ago, but she had to pay for it. So she handed him a check for $65 to pay for the drug test at the end of october. The test was done on Nov 4 and came out THC positive, according to a copy his parole officer sent to my wife. But the check hasn't been cashed yet or returned. It's been a month now and my wife is getting scared the guy can do something not good with it. My question is: is it legal to hold a check after it wasn't used for what it was supposed to? Thanks.
