Breach of Contract
Coral Springs, Florida 33065

Would an independent contractor who was giving music lessons for our company be in a breach of contract if he.
1-Did not give our company 30 notice that he was leaving as stated on his contract. [This agreement will become effective on ___________ 2001 and will continue in effect until such time as the Client or Contractor giving 30 days written notice to terminate agreement upon completion of this agreement.]
2-Told all his students he was taking the summer off and not notifying us giving us the opportunity to transfer students to another teacher. We are an all year round business and summers off are not our policy. He also told some students if they do not take the summer off they can not return to him and he never made arrangements to return to work for our company.
3-We had lost 100% of his students, are we entitled to compensation?
We also held his compensation as stated in the contract agreement. [Compensation will not be paid if contractor is derelict of obligation to student due to inappropriate behavior of contractor to be deemed by Music Lessons In Your Home.] Do I have the right to do that?
[The Contractor will further act in a businesslike manner to be determined by the Client and the Contractor will be subject to fines, prosecution, legal fees, and immediate termination by the Client if the Client feels that the Contractor has acted inappropriately at any time".]
4-Would he be obligated to pay attorney fee’s if need be?
