We are renting with option to buy, they she did not have the whole deposit when moving in we said to pay in one month, this was Aug 2000 now March 2001 she has not paid her deposit, first does this break the lease. nThen in Feb she was to put down ans do land contract. In the mean time her deposit was to pay up back payment and insuriance because of lack of her payement we was behind and they forclosed and gave us 6 months to refinance or sell, she is tring to get a loan to buy or we will try to refinance but my question is can she leagally with hold the rent she broke the lease when she did not pay deposit and did not want to do contract till we got it settled, which if she did it would have been. Now she has stopped paying and what can we do we still own the house till Sept. Thank you

If the lease is broken, then she is not obligated to pay further rent. If you don't have a contract, then what is she obligated to do?

It was a lease of rent with option to buy she is tring to get a loan and was to buy in Feb but lease did say rentwith option so would she not still responsible for the rent???
