holiday question

What is the name of your state? MI

How should someone handle the holidays when this is the situation....

My husband has visitation every other weekend. Christmas falls on his weekend to have his daughter. If the paperwork states that he gets her from the date that school is out until christmas eve, how does this work if christmas day still falls on HIS weekend to have her??? Its a little bit of a contridiction and confusing... any ideas as to how to handle this?

Holiday visitation overrides regular visitation. For Christmas break, your husband gets only his holiday visitation, none of his regular visitation.
 
Do you know or understand why that is???? he barely gets to see her now and the holiday visitation schedule cuts his time with her by almost 2 days. I'm confused on it.

that is just the way it is, holidays are special times so court orders are designed to make sure the child get to be involved as equally as possibly with each parent. and as was said before holiday visits over ride regular schedules.

That is simply the way that it works. Holiday visitation overrides regular visitation. How is it that it gives him less time with her? What day does she get out of school? In my school district, that would be giving him a week with her during Christmas break.
 
I understand that. It just confuses me. It really doesn't come up that equal but I understand that the holidays are supposed to be equally spent. It is just that my husband gets to see his daughter 6 days a months because of the mother makes up excuses on the other days he is able to see his daughter. Christmas is another one of those times where the excuses come out. SHould he contact the courts to see if an exception can be made, such as more time during the week before christmas? Is that even possible?

The disrtict in which his daughter lives in gets out December 22nd. That gives him that night through the 24th. And that confuses me too.... I thought it was a longer vacation time for them and it isn't. That's why I'm wondering ... can an exception be made??
 
I should have stated this before... I'm just the step mom... I know I can't do anything, but I am asking in his behalf to try and help him be informed.

I don't know if the mother will be reasonable enough to comprimise and extra day or time. She hasn't been so far on anything.

That certainly would not be possible for this year. There would be almost no chance that you could get it into court for this year. However, its definitely a possibility for the future.

You also need to remember that the school schedule will be different from year to year.

This is a completely seperate issue from holiday visitation. If mom is in contempt of the court order on other visitation days, that needs to be addressed. However, for the holiday, dad must follow the CO which essentially gives mom his weekend over the break.

You're not the only ones faced with this. According to the every other weekend schedule, Xmas is my Ex's weekend. But Christmas is MY holiday (as well as the first half of Christmas vacation and Christmas Eve since it's the Oldest Child's Bday). He'll not get them on that weekend. However, NYears 'should' be my weekend (going by EOW) and it's his - including the last half of Xmas break - and I won't get them back til the evening of the 3rd meaning I miss my Sunday night/Monday with the kids as well.

That's the way it works. It occasionally results in one of us having the kids for 3 weekends in a row (as I did in November due to it being my year for TGiving) or whatever, but it's the most 'fair' way to accomplish things.

yep, because my normal weekend fell on the thanksgiving weekend I didn't get a visit with my son for 20 days, would have been longer had he not had a long weekend the week before, still nothing I could do about, just the way it is.

sometimes it will work in your favor other times it will work out in the exes favor, hopefully it all works out in the wash :)
