Holiday vs. Weekend visitation

What is the name of your state? Idaho

I am to have up to three vistation weekends with my kids each onth, the first weekend, third weekend, and I can choose the other as long as I give the ex 72 hours notice. I requested the 2nd weekend in December, he is saying no because I have them the second half of the Christmas holiday for visitaton.

In the order, it states that holiday visits that fall on the other parents regular weekend with the kids can't be made up, so lets say his holiday falls on the first weekend of the month (which would be mine) I would have to forfeit that weekend, and vice-versa.

Should the weekend falling in the holiday be counted as my third regular visit? I would love some clarification on this if anyone knows.

holidays are NOT counted as regular time, so no it would not be counted as your third regular visit

you have the weekend of the 2/3/4, then the weekend of the 16/17/18, then whatever other weekend you choose, you have requested 9/10/11

the holiday schedule proceeds on its own, however you are certainly free to compromise with dad

Holidays and special days supercede the regular visitation schedule. Your ex has no choice but to allow you to have the child on the second weekend if you gave the other parent proper notice.
